Chapter 1 General Provisions
Article 1 (Purpose)

The purpose of these terms and conditions is to define the conditions and procedures for using all services (hereinafter referred to as "Services") provided by the Modern English Education Society (hereinafter referred to as the "Society") website, and to regulate the rights, obligations, responsibilities, and other necessary matters between the user and the Society website.

Article 2 (Effect and Modification of the Terms and Conditions)
  • All services provided by the Society website are subject to the user's agreement to these terms and conditions, and these terms and conditions shall apply first to the Society's service provision and the user's service use.
  • The Society may change these terms and conditions without prior notice if reasonable grounds arise, and the changed terms and conditions will take effect immediately after being posted on the Society website or notified to members by email.
  • If the user does not agree to the changed terms and conditions, the user may cancel (withdraw from) their membership registration. If the user continues to use the Society website after 7 days from the date of the changed terms and conditions without expressing their refusal, it will be deemed that they have agreed to the changed terms and conditions.
  • Agreeing to these terms and conditions means agreeing to regularly visit the Society website to check for changes to the terms and conditions. The Society website shall not be liable for any damages incurred by users who are not aware of changes to the terms and conditions.
Article 3 (Supplementary Provisions)

Matters not specified in these Terms and Conditions shall be governed by the provisions of the Telecommunications Basic Act, the Telecommunications Business Act, the Regulations on the Deliberation of the Information and Communication Ethics Committee, the Code of Ethics for Information and Communication, the Program Protection Act, and other relevant laws and regulations.

Article 4 (Definitions of Terms)

The definitions of the terms used in these Terms and Conditions are as follows:

  • "User" refers to a person who receives the services provided by the academic society website in accordance with these Terms and Conditions.
  • "Registration" means the act of filling out the application form provided by the academic society website, agreeing to these Terms and Conditions, and completing the service usage agreement.
  • "Member" refers to a person who has registered personal information with the academic society website and can use the information and services provided by the academic society website.
  • "ID" refers to a combination of letters and numbers selected by the user within the academic society website to identify the user and to use the services.
  • "Password" refers to a combination of letters and numbers selected by the user within the academic society website to confirm whether the user is the same person as the registered member and to protect their personal information in communication.
  • "Withdrawal" means the act of terminating the service usage agreement by the member.
Chapter 2. Agreement for Use
Article 5 (Establishment of Agreement for Use)
  • The agreement for use is established when the applicant completes the registration process by entering the required information on the designated registration form provided by the academic society's website and agrees to the terms of use of the website.
  • The agreement to these terms of use is expressed by checking the box indicating "I agree to the homepage terms of use" on the relevant page of the academic society's website.
Article 6 (Application for Service Use)
  • A member who wishes to use the services of the academic society's website must provide the information requested by the website and complete the registration process to become a member.
  • All members must provide their real name, contact information, date of birth, email, and address for identification verification to be able to use the services. If a member provides false information, they may be restricted from using the services.
  • Membership registration must be done using the member's real name.
  • If a member applies for services using another person's name or personal information, their ID may be deleted without prior notice, and they may be punished according to the relevant laws and regulations.
Article 7 (Protection and Use of Personal Information)
  • The Society shall enforce a personal information handling policy to protect the personal information of service users in accordance with the relevant laws and regulations. The protection and use of user personal information shall be subject to the relevant laws and regulations and the Society's personal information handling policy. However, the Society shall not be responsible for any information exposure resulting from the user's own fault.
  • The member information on the Society's website shall be used, managed, and protected as follows:
    • 1. Use of Personal Information: The Society's website shall not disclose or distribute the member's personal information collected in relation to the provision of services to a third party without the member's consent. However, if there is a request from a government agency under the provisions of laws such as the Telecommunications Basic Act, for investigation of a crime, a request from the Korea Internet & Security Agency, or if there is a request following the procedures prescribed by other relevant laws, it shall be exempted. It also shall not be exempted if the user has voluntarily disclosed their personal information on the Society's website.
    • 2. Management of Personal Information: Users can modify or delete their personal information in the personal information management section of the service to protect and manage their personal information.
    • 3. Protection of Personal Information: User's personal information can only be accessed, modified, or deleted by the user, and it is primarily managed by the user's ID and password. Therefore, users should not disclose their ID and password to others, and they must log out from the website and close the web browser window when finishing their tasks.
  • By applying for membership on the Society's website in accordance with these terms and conditions, the user is deemed to have agreed to the collection and use of the member's information stated in the application form by the Society's website.
Article 8 (Approval and Limitation of Service Use Application)
  • The Society approves the use of the service to the applicant under the provisions of Article 6, unless there is any obstacle in performing the business or technical aspects.
  • The Society does not approve the service for the following cases:
    • 1. If the applicant uses another person's name or if the name is not the real name.
    • 2. If the applicant provides false information on the membership application form or applies for it falsely.
    • 3. If the applicant obstructs the use of the Society's site services or steals the information.
    • 4. If the applicant violates laws and regulations and the terms and conditions of this Agreement using the Society's site.
    • 5. If the applicant fails to meet other requirements for the use of the service set by the Society.
  • The Society may withhold approval of the service application if it falls under the following items until the reasons for withholding approval are resolved:
    • 1. When there is no spare capacity in the web operating equipment of the Society site.
    • 2. When there is a technical obstacle to operating the web of the Society site.
    • 3. When it is difficult to approve the use due to the Society's attributable reasons.
  • When the service application is not approved or approval is limited under the provisions, the Society shall immediately inform the applicant.
Chapter 3 Rights and Obligations of Contract Parties.
Article 9 (Rights and Obligations of the Society)
  • The Society must have a security system in place to protect the personal information of users, in order to ensure that they can use the Society's services safely.
  • The Society has an obligation to protect the personal information of members in accordance with the privacy policy established by the Society. The Society shall not disclose or distribute a member's personal information to a third party without their consent, except where required by related laws and regulations, such as the Telecommunications Business Act and other relevant national agencies.
  • If the Society wishes to use a member's personal information beyond the scope notified or stated in accordance with the provisions of paragraph 2, or provide such information to a third party, it must first individually notify the member and obtain their consent.
  • The Society shall promptly repair or restore its facilities in the event of equipment failure or loss, to ensure the continuous and stable provision of services. However, in case of natural disasters, emergencies, or other unavoidable circumstances, it may temporarily suspend or terminate such services.
  • The Society must provide convenience to members in matters related to the conclusion, modification, and termination of membership contracts, and other contractual procedures and contents.
  • If opinions or complaints raised by members are deemed reasonable, the Society must immediately handle them. However, if immediate handling is difficult, the Society must notify the member of the reason and processing schedule in writing, by email or telephone, etc.
  • The Society may create statistical data on all or part of the personal information of the members with their prior consent, in relation to its business, and may transmit cookies to the member's computer through the Service. A cookie is a small amount of information that a website server sends to a user's computer, which contains information about the visited website and the user's personal information necessary for confirming the provision of services. Members have the option to choose whether to install cookies. Therefore, members can allow all cookies by setting options in their web browser, or go through confirmation each time a cookie is saved, or refuse to save all cookies. However, if the storage of cookies is refused, some services of the Society that require login may be difficult to use.
Article 10 (Rights and Obligations of Members)
  • The subscriber must provide accurate information when joining as a member. In addition, the information provided about the member must be maintained and updated to ensure that it is accurate.
  • Members must not allow third parties to use their ID and password.
  • Members cannot transfer or donate their status as a user of the service or offer it as collateral without prior consent from the academic society.
  • Members cannot exclusively use the entire or part of the content and functions of the service without prior approval from the academic society.
  • Members cannot engage in profitable activities using the service without explicit prior consent from the academic society, and the academic society is not responsible for any results arising from such violations. Members are liable for damages to the academic society resulting from such profitable activities.
  • Members must not engage in the following activities while using the service.
    • 1.Illegally using another member's ID and password.
    • 2.Copying, processing, translating, reproducing, performing, broadcasting, exhibiting, distributing, publishing, or providing to third parties information obtained through the service for purposes other than personal use.
    • 3.Infringing upon the academic society's or third party's copyright or other rights, or posting, publishing, transmitting, or distributing content that infringes upon another's patent, trademark, trade secret, copyright, or other intellectual property rights.
    • 4.Damaging another's reputation or causing harm.
    • 5.Transmitting, posting, publishing, distributing, or sending via email or other means content that cannot be used under the law or contract, or content that is obscene, vulgar, defamatory, threatening, or infringes on another's privacy.
    • 6.Distributing to others content such as information, sentences, graphics, or voice that violates public order or morals.
    • 7.Posting, publishing, transmitting, or distributing unapproved advertisements, promotional materials, spam, chain letters, pyramid schemes, or other types of solicitations on the academic society's website.
    • 8.Acts aimed at causing the malfunction or destruction of equipment related to the service or information, such as distributing computer viruses or malicious codes or hacking.
    • 9.Any acts that may disrupt the stable operation of the academic society's website service.
    • 10.Acts aimed at committing crimes or other illegal activities.
    • 11.Acts subject to corrective measures requested by reputable organizations such as the Korea Communications Standards Commission or consumer protection groups, violations of election laws resulting in suspension, warning, or corrective orders from the election management committee, or violations of Article 53(1) of the Electric Communication Business Act or Article 16(Unfair Communication) of the Enforcement Decree of the Electric Communication Business Act.
    • 12.Acts in violation of other related laws and regulations
  • Members must comply with the provisions of these terms and conditions, the service usage guide, or cautionary notes, and also comply with any notices or separately posted matters announced by the Society.
Chapter 4 Use of the Service
Article 11 (Service Hours)
  • The service is available 24 hours a day, 365 days a year unless there is a special obstacle in the association's business or technology.
  • The association may temporarily suspend the service on the day or time designated by the association for system regular inspection, expansion, or replacement, and advance notice of the service interruption due to the scheduled work will be provided through the website.
  • In case of service interruption due to reasons beyond the control of the association (such as disk failure without intentional or negligent action by the system administrator, system downtime, etc.), it is impossible to give advance notice, and in case of system interruption due to intentional or negligent actions by others (telecommunications business operators, etc.), no notice will be given.
Article 12 (User Information Security)
  • The user is responsible for maintaining the confidentiality of the information entered from the moment the user completes the registration process for the Society's website service, and the user is solely responsible for any consequences that arise from the use of the member's ID and password.
  • The member is solely responsible for all management related to the member's ID and password, and if the member discovers that the ID or password has been used improperly, the member must immediately report it to the Society's website. The member is solely responsible for any damages resulting from failure to report such incidents.
  • The user must accurately terminate the connection with the site each time they finish using the Society's website service, and the Society's website is not responsible for any damages or losses resulting from third-party use of the user's information due to the failure to terminate the connection accurately.
Article 13 (Management of Posts)
  • The Society may delete, move, or refuse to register in advance the following posts or materials without notice:
    • 1.Contents that severely insult or damage the honor of other members or third parties.
    • 2.Contents that violate public order and morals or distribute links to such contents.
    • 3.Posts that are deemed commercial, illegal, obscene, or vulgar.
    • 4.Contents that promote illegal replication or hacking.
    • 5.Advertisements for profit.
    • 6.Contents that are objectively recognized as being associated with crimes.
    • 7.Contents that infringe upon the copyrights or other rights of other users or third parties.
    • 8.Posts that violate the posting principles set by the Society or are not suitable for the nature of the bulletin board.
    • 9.Other cases that violate relevant laws and regulations.
  • The Society's website is not responsible for the reliability, accuracy, or other contents of the information, data, or facts posted by members in this service, and is not responsible for any profit or damage expected from the use of the information posted by these members or the service.
Article 14 (Copyright of Posts)
  • The rights to the content of the posts posted by users belong to the users themselves.
  • The civil and criminal liabilities arising from the infringement of third-party copyrights by users' posts are solely borne by the users.
  • Members cannot use the materials posted on the service for commercial purposes, such as processing or selling the information obtained through the service.
  • The society may delete, move, or refuse registration of the contents or postings within the service posted or registered by the members without prior notice if it is determined to fall under any of the items in Article 13.
Article 15 (Provision of Information)

The society may provide members with various information that is deemed necessary during the use of the service via email, phone communication, or other methods.

Chapter 5. Termination of Agreement and Restrictions on Use
Article 16 (Change and Termination of Agreement)
  • If a user has a reason such as not wanting to receive the services provided on this site after joining as a member, they may withdraw (terminate) their membership at any time, and the information entered at the time of registration will be immediately deleted upon withdrawal.
  • If a member wishes to terminate the usage agreement, they must use the 'Membership Withdrawal' menu on the association's website to withdraw from the membership themselves.
Article 17 (Restriction of Service Use)
  • The Society may restrict the use of the Service by a Member if the Member violates the contents of Article 10 of these Terms and Conditions or falls under any of the following subparagraphs in using the Service:
    • 1. Use of vulgar user ID or nickname that harms public decency
    • 2. Cases of severe defamation or interference with the use of the Service to other users
    • 3. Cases that may disturb the normal operation of the Service
    • 4. Cases where there are corrective requests from relevant public institutions such as the Information and Communication Ethics Committee
    • 5.
      Cases of posting illegal materials on bulletin boards
      • a.Cases where commercial software or crack files are uploaded
      • b.Cases where pornographic materials that violate Article 7 of the Review Rules of the Information and Communication Ethics Committee are posted
      • c.Cases containing content that aims to perform acts against the state
      • d.Cases of unauthorized reproduction of copyrighted works or uploading of MP3 files
    • 6.Cases of distributing computer virus programs that may cause malfunction of information and communication equipment or destruction of information.
Chapter 6. Compensation for Damages and Other Matters
Article 18. Scope and Claim of Compensation for Damages
  • The Society shall not be liable for any damages incurred by a member in connection with the free services provided on the Society's website, except for intentional criminal acts.
  • If the Society receives claims for compensation for damages, lawsuits, or other objections from third parties, other than the member who caused illegal acts while using the service, the member shall make efforts to exempt the Society from liability. If the Society cannot be exempted from liability, the member shall compensate the Society for all damages incurred.
Article 19 (Exemption from Liability)
  • In the event that the service cannot be provided due to force majeure, such as natural disasters, war, or other similar circumstances, the Society shall be exempted from liability for the provision of the service.
  • The Society shall be exempted from liability in the event that damages arise due to the suspension or improper provision of telecommunications services by a telecommunications service provider.
  • The Society shall be exempted from liability for damages arising from the unavoidable circumstances of maintenance, replacement, periodic inspection, construction, etc. of service equipment for providing a more stable service to its members.
  • The Society shall not be liable for any obstacles or damages caused by the member's fault in using the service.
  • The Society shall not be liable for damages caused by errors in the user's computer or by the member's insufficient provision of personal information, including contact information and address.
  • The Society shall not be liable for the reliability, accuracy, or other contents of various information, data, and facts posted by members on the service.
  • The Society's website shall not be liable for any transactions, such as the trade of goods or financial transactions, between members or between members and third parties facilitated by the service, and shall not be liable for any expected benefits related to the use of the service by members.
  • The Society's website shall not be liable for damages caused by the user's intention or negligence among the damages incurred by the user in connection with the use of the service.
Article 20 (Jurisdiction and Dispute Resolution)
  • Matters not specified in this Agreement shall be governed by relevant laws and regulations such as the Telecommunications Business Act.
  • In the event of a dispute between the Association and a member regarding the use of the Service, the dispute cannot be filed in court unless the parties have made sincere efforts to resolve the dispute.
  • In the event of a lawsuit regarding a dispute arising from the use of the Service, the court with jurisdiction over the location of the Association shall be the competent court.
[Supplementary Provisions]

Supplementary Provision 1. (Effective Date) This Agreement shall come into effect on January 1, 2023.

Consent to the Collection and Use of Personal Information (Required)

The "Modern English Education Society" (hereinafter referred to as "the Society") establishes and discloses this privacy policy in order to protect the personal information of information subjects in accordance with Article 30 of the Personal Information Protection Act and to handle related complaints promptly and smoothly.

Article 1 (Purpose of Personal Information Processing)

The purpose of processing personal information files registered and disclosed by the Society in accordance with Article 32 of the Personal Information Protection Act is as follows:

  • Personal information file name: Consent to Privacy Policy
  • Purpose of processing personal information: Membership registration
  • Collection method: Website, written form, phone/fax
  • Basis for retention: Enforcement Decree of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.
  • Retention period: Until the member withdraws from membership
  • Related laws and regulations: Record of collection/processing and use of credit information: 3 years.
Article 2 (Matters concerning provision of personal information to third parties)
  • The Modern English Education Society (hereinafter referred to as the "Society") processes personal information only within the scope specified in Article 1 (Purpose of Processing Personal Information) and provides personal information to third parties only in cases where the information subject has consented or where special regulations under Articles 17 and 18 of the Personal Information Protection Act apply.
  • The Society provides personal information to third parties as follows.
Article 3 (Matters concerning the consignment of personal information processing)
  • The Society consigns personal information processing tasks as follows for smooth personal information processing.
  • When entering into a consignment contract, the Society specifies matters such as prohibiting the processing of personal information other than for the purpose of performing the consigned tasks, technical and managerial protective measures, restrictions on re-consignment, and responsibility for management and supervision of the consignee and compensation for damages, in accordance with Article 26 of the Personal Information Protection Act. The Society also supervises whether the consignee securely processes personal information.
  • If the content of the consigned tasks or the consignee is changed, we will promptly disclose it through this personal information processing policy.
Article 4 (Procedure and Method of Personal Information Destruction)
  • The Society shall destroy personal information without delay when personal information becomes unnecessary due to the lapse of retention period of personal information or achievement of the purpose of personal information processing.
  • If personal information must be preserved under other laws despite the lapse of the retention period agreed by the information subject or the achievement of the purpose of processing, the Society shall move the relevant personal information to a separate database or store it in a different location.
  • The procedure and method of personal information destruction are as follows:
    • 1.Procedure of destruction:
      <Hyundai English Education Society> selects the personal information for destruction, obtains approval from the personal information protection manager of <Hyundai English Education Society>, and destroys the personal information.
    • 2.Method of destruction:
      For electronically stored information, technical means that make it impossible to reproduce the record shall be used. For personal information printed on paper, it shall be destroyed by shredding or incineration.
Article 5 (Rights and Obligations of Data Subject and Legal Representative and Method of Exercising Such Rights)
  • The data subject may exercise the right to access, correct, delete, and request processing suspension of personal information from the Modern English Education Society at any time.
  • The exercise of the rights under paragraph 1 may be made in writing, by electronic mail, facsimile transmission (FAX), etc. to the Modern English Education Society pursuant to Article 41(1) of the Enforcement Decree of the Personal Information Protection Act, and the Modern English Education Society shall promptly take measures in response thereto.
  • The data subject may exercise the rights under paragraph 1 through his/her legal representative or delegate. In this case, the delegate must submit a power of attorney in accordance with Attachment No. 11 of the Guidelines for the Processing of Personal Information (No. 2020-7).
  • The data subject's right to access and request processing suspension may be limited pursuant to Article 35(4) and Article 37(2) of the Personal Information Protection Act.
  • If the personal information is expressly provided for collection by other laws, the data subject cannot request its correction or deletion.
  • The Modern English Education Society verifies that the person requesting access, correction/deletion, or processing suspension in accordance with the data subject's rights is the data subject himself/herself or a legitimate representative.
Article 6 (Measures to Ensure the Security of Personal Information)

The Society is taking the following measures to ensure the security of personal information:

  • 1.Minimization and education of personal information handling staff: We have implemented measures to minimize the handling of personal information by designating personnel and limiting them to responsible staff.
  • 2.Establishment and implementation of an internal management plan: We have established and implemented an internal management plan for the safe processing of personal information.
  • 3.Technical measures to prepare for hacking, etc.: The Society has installed security programs, periodically updated and checked them, and installed systems in areas where access is controlled to monitor and block external access to prevent leakage or damage of personal information caused by hacking or computer viruses.
  • 4.Encryption of personal information: Users' personal information is stored and managed in an encrypted format, and important data is protected with additional security functions such as encryption of files and transmission data or the use of file locking functions, which only the user can access.
  • 5.Preservation and Prevention of Falsification of Access Records: We keep and manage access records to personal information processing systems for at least one year. However, we keep and manage them for more than two years if we add personal information about more than 50,000 subjects or process unique identification information or sensitive information. In addition, we use security functions to prevent access records from being falsified, stolen, or lost.
  • 6.Restriction of Access to Personal Information: We take necessary measures to control access to personal information by granting, changing, and revoking access rights to the database system that processes personal information. We also use an intrusion prevention system to control unauthorized access from outside.
  • 7.Use of Locking Devices for Document Security: We store documents and auxiliary storage media containing personal information in a secure location with locking devices.
  • 8.Access Control for Unauthorized Persons: We have a separate physical storage location for personal information and have established and operate access control procedures for it.
Article 7 (Installation, Operation, and Rejection of Devices that Automatically Collect Personal Information)

The Modern English Education Society does not use 'cookies' that store and retrieve usage information of information subjects.

Article 8 (Matters concerning the Personal Information Protection Officer)
  • The Modern English Education Society is responsible for overall management of personal information processing, and has designated a personal information protection officer as follows to handle complaints and remedies related to personal information processing:

  • Information subjects may contact the personal information protection officer or department regarding any inquiries, complaints, remedies, etc. related to personal information protection that arise while using the services (or business) of the Modern English Education Society. The Modern English Education Society will respond and handle such inquiries without delay.
Article 9 (Department to Receive and Process Requests for Access to Personal Information)

An individual may request to access their personal information under Article 35 of the Personal Information Protection Act to the following department:

Article 10 (Remedies for Infringement of Rights of the Data Subject)

The data subject may apply for dispute resolution or counseling at the Personal Information Dispute Mediation Committee or the Korea Internet & Security Agency Personal Information Infringement Report Center to receive remedies for personal information infringements. For reporting and counseling on other personal information infringements, please contact the following institutions:

Individuals who have suffered harm to their rights or interests due to a public institution's disposition or arbitrary action in response to requests made under the provisions of Article 35 (Request for Access to Personal Information), Article 36 (Request for Correction or Deletion of Personal Information), and Article 37 (Request for Suspension of Processing of Personal Information) of the Personal Information Protection Act may request administrative adjudication in accordance with the Administrative Adjudication Act.

Article 11 (Changes to the Personal Information Handling Policy)

This Personal Information Handling Policy will be in effect from January 1, 2023.
